§ 2-1. Referendum petitions.

  • (a)

    All referendum petitions, pursuant to amendment 7 to the Arkansas Constitution, except those pertaining to bond issues, must be filed with the city clerk within 60 days after passage of the ordinance which is the subject of the petition. Referendum petitions pertaining to bond issues must be filed with the city clerk within 30 days after passage of the ordinance which is the subject of the petition.

    (b)

    The sufficiency of any referendum petition shall be decided in the first instance by the city clerk, subject to review by the chancery court, provided that suit to review the city clerk's determination must be brought within 30 days.

    (c)

    If a referendum petition is in all respects sufficient and proper, the city council may order a special election or place the question on the ballot at the next municipal general election to determine by vote of the qualified electors whether the ordinance shall stand or be revoked. The date for any special election shall be not less than ten days after the order therefor has been made by the council, and such special elections shall be had and conducted as general municipal elections held in the city.

    (d)

    If any ordinance referred to the people is defeated at the polls, the city council shall make a note of such fact on the ordinance.
